The appeal is called at 12.40 p.m. today for hearing.  None is present for the appellant. Adv. Mr N Lambat is present for the respondent. 

Perusal of the record & proceedings of the appeal shows that though direction was given to the appellant long back, he did not file Written Notes of Arguments till this date.  On 11.04.2016 advocate of the appellant had sought adjournment for filing written notes of arguments and it was granted as a last chance subject to depositing cost of Rs.5,000/-  with Legal Aid Account of this Commission.  The appeal was then adjourned till 11.07.2016. On that date none appeared for the appellant and the said cost was also not deposited.  Therefore, the appeal came to be adjourned for appropriate order till 31.08.2016. On 31.08.2016 also none had appeared for the appellant. Therefore, the appeal came to be adjourned till this date again for appropriate order.  Today also neither the appellant has appeared nor it is seen that the appellant deposited cost of Rs.5,000/- with Legal Aid account of this commission. Therefore, the appeal deserves to be dismissed in default.

In the result, the appeal is dismissed in default.

No order as to costs in this appeal.

Copy of this order be supplied to both parties free of cost.
