            This complaint has been filed by the complainant u/s 12 of C. P .Act, 1986 praying for a direction to refund the proposal deposit of Rs11,998/- and Rs.17,197/- which have been deposited on 31.10.10 along with interest @ 12% p.a. and compensation of Rs.50,000/-  for mental pain, agony and harassment.

            The notices have been sent to the OPs. OP appeared by filing Vokalatnama empowering Ld. Adv Saugata Biswas, who on his turn filed a petition praying time to file written version.  

            Today by filing a petition the Ld. Advocate for the complainant states that the complainant is not willing to proceed with this case anymore as the dispute has been amicably settled between the parties.  Ld. Adv on behalf of the OP submits that he has no objection if the complainant withdraws this complaint petition.

            In this situation, as per the version of the Ld. Advocate for the complainant, we are of opinion that we should not stand on the way of pious wishes of the complainant. As such the case should be disposed of as withdrawn.

            Hence,

That the Consumer Case No. 83/2016 be and the same is hereby disposed of as withdrawn.                           

Let a plain copy of this Order be supplied free of cost to the parties/their Ld. Advocates/Agents on record by hand under proper acknowledgement/ sent by ordinary Post for information & necessary action.
