FAIR ORDER

Sri. E.M.MUHAMMED IBRAHIM , B.A, LLM,President

Objection filed.  Heard both sides.  This is a petition filed on behalf of the complainant in C.C.No.173/2018 praying to review the order of dismissal of complaint for default.

The opposite party resisted the petition on the ground that this forum has no jurisdiction to entertain a review petition or to set aside exparte order and restore the complaint which was dismissed for default.  It is crystal clear from Section 24 of the Act that each and every order passed by the CDRF is final unless and until it is challenged in appeal.  Hence the only remedy available to the complainant is challenge the order of dismissal of the complaint for default in appeal and get it set aside.

In view of the reasons stated above we find no merit in this petition.  Hence the same stands dismissed.

No costs.

Dated this the 17th  day of January 2020.
