None is present for the appellant when the appeal is called for haring at 2.00 p.m. Advocate Mr W G Paunikar is present for the respondent.

Perusal of the record & proceedings of the appeal shows that Advocate Mr C Kulkarni for the appellant had appeared and filed power on 12.01.2016.  On that date, direction was given to the appellant’s advocate to furnish appeal compilation to Advocate Mr W G Paunikar, who was present for the respondent. The appeal was then adjourned till 22.03.2016.  On that date, none had appeared for the appellant. The appellant also did not file Written Notes of Arguments.  The appeal was then adjourned to 17.06.2016.  On that date, none had appeared for the appellant. The respondent’s advocate was present and he filed his Written Notes of Arguments. The appeal was adjourned till 16.08.2016 for filing Written Notes of Arguments by the appellant. On 16.08.2016 none appeared for the appellant though advocate of the respondent was present. The appeal was then adjourned till 22.09.2016 for appropriate orders.  On 22.09.2016 also none had appeared for the appellant and again the appeal came to be adjourned till this date for appropriate orders.

Today also none appeared for the appellant. Written Notes of Arguments are also not filed by the appellant.

Hence, the appeal is dismissed in default.

No order as to costs in this appeal.
