Complainant is absent. Attendance on behalf of o.p No. 3 has been filed.

                     Heard the learned lawyer for the o.p no.3. None present on behalf of complainant to argue the matter. Perused the record. On perusal of record it transpires that this Misc. petition has been filed against the order dated 12-09-2015 passed in C. Case No. 136/2012 wherein and whereunder this court  has dismissed the complaint petition vide order dated 12-09-2015. This Misc petition has been  filed to recall the order passed on 12-09-2015 and to restore the complaint case in its original stage.

          In the case of Rajeev  Hitro Pathak V/s  Achut Kashi Nath Kakkar and another, civil appeal No.- 4307/2007 with civil appeal no.- 8155/2000 Hon’ble Supreme Court of India has been pleased to observe that this forum is not entitled to recall or review its own order. On perusal of record it also transpires that complainant is absent since 04-04-2019 and he was direct to take part in hearing on the next date but he is not appearing before this forum. In the circumstances this Misc. petition is dismissed.
