Final Order / Judgement

Hazira is filed on behalf of the complainant by his Ld. Advocate.

          Heard the Ld. Advocate for the complainant in the matter of admission hearing. Perused the petition of complaint and the Xerox copies of the documents. Considered the submission of the Ld. Advocate of the complainant. On perusal of the instant complaint and documents filed, it appears that cause of action started from 15.07.2008 with the alleged incident of widespread death of prawns in the ponds of the complainant and the said incident was informed to the Fishery Officer, Moyna BDO on 16.07.2008 and to Divisional Manager of the OP on 01.09.2008 and to Naichanpur –II Gram Panchayat on 19.07.2008. But the instant case has been filed on 22.06.2012 i.e. after a lapse of more than 3 years from the date of aforesaid alleged incident i.e. cause of action.

          There is also no whisper in the complaint as to any cause for delay in filing the instant case beyond the period of limitation as specified u/s 24A of the C.P. Act, 1986.

          Under such circumstances, this complaint can not be entertained for proceeding further. Hence, the instant petition of complaint is rejected since barred by limitation.
