HON’BLE JUSTICE SRI A. CHAKRABARTI, PRESIDENT.

 

Appellant through Mr. Paritosh Hazra, the Ld. Advocate and Respondent through Mr. N. R. Mukherjee, the Ld. Advocate are present.  Heard the Ld. Advocate for the Appellant and Mr. Mukherjee, the Ld. Advocate for the Respondent.  The appeal has been filed by the Complainant though by the impugned order the complaint was allowed, allowing Rs. 1,000/- as medical reimbursement and Rs. 500/- as litigation cost.  The contention of the Ld. Advocate for the Appellant is that the Complainant had to proceed with the appeal as her expenditure was much more and she was entitled to reimbursement of the larger amount and she is also entitled to further amount in respect of litigation cost.

 

On being questioned the Ld. Advocate was unable to produce any material in support of his claim as regards litigation cost.  With regard to medical reimbursement also it appears that the said sum was earlier tendered by the Respondent but was not accepted by the Complainant.  Therefore, we are of the opinion that no further interference is required with the impugned order and the appeal is dismissed.
