FINAL ORDER

This is an Execution Application for realization of Rs.3, 95,310/- .

This Execution Application was filed on 17.12.2007. This day is fixed for showing cause by the D.hr. for his consecutive absence without any steps as to why the case shall not be dropped for non-prosecution.

The D.hr. has filed a petition showing cause that he could not attend the Forum for his physical illness and for the same he was not deliberately remained absent and prays for condolence for his absence.

Further he has stated in the petition that he has already received the entire awarded amount as prayed for realization in this Execution Application with full satisfaction from the Ops and for that prays for dismissal of the Execution Application with full satisfaction.

Heard the Ld. Lawyers of both sides. Perused the material on record and also the submission of the D.hr as well as the Ld. Lawyer of both sides.

Considering the above verified petition as well as the submission, we find that the D.hr. has received the awarded amount with full satisfaction from the Ops for that the Execution Application be disposed of on full satisfaction.

Hence,

                                                  Ordered

that the Execution Application No. 180/2007 be and the same is disposed of with full satisfaction.

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under registered post with A/D to the concerned parties as per rules, for information and necessary action.
