1.The Complainant has lodged this complaint against the O.P. No.1 alleging inter alia that his motorbike bearing registration No.TR01 AL 6312, being insured with the O.P. No.1 was stolen on 05/07/2019 when he parked the bike in front of his house. He registered G.B. Out Post G.D. Entry No.13 of 20/02/2020.
2.The Complainant claimed compensation with the O.P. No.1 on 30/06/2020 by issuing notice as earlier inspite of information being given the O.P. No.1 did not settle the claim. The O.P. No.2 being financer of the bike is not a necessary party in fact.
3.The O.P. No.2 pleaded that it is not a necessary party. And the O.P. No.1 most casually denied the claim of the claimant on the ground that the Complainant has not cause of action.
4.Both the sides submitted evidence on affidavit. The Complainant submitted, copy of claim dt. 20/02/2020 submitted to the O.P. No.1, copy of policy of Insurance and copy of G.D. Entry.
5.Hearing argument the only point emerges for decision whether the O.P. No.1 is guilty of deficiency in service?
DECISION AND REASONS FOR DECISION:-
6. The claim notice dt. 20/02/2020 proves that before filing this complaint, the Complainant asked for compensation for the theft of his motorbike but the O.P. No.1 inspite of having valid policy of insurance covering the date of the theft neither paid compensation nor repudiated the claim showing any reason. The policy of Insurance shows that the motorbike bearing registration No. TR01-AL-6312 was duly insured with the O.P. No.1. The claimant by submitting copy of G.D. Entry No.13 of 20/02/2020 has proved the factum of theft as well.
The point is decided in affirmative accordingly.
7. In the result it is ordered that the O.P. No.1 shall pay Rs.80,238/- i.e. the insured value of the Motorbike to the Complainant with interest @7.5% P.A. from the date of claim i.e. 20/02/2020 till the date of actual payment.
The case stands disposed off.
Supply a certified copy of this final order to both the parties free of cost.
