The complainant filed this complaint for directing the OPs to pay the claim of Rs.60,000/- for the dose of September, 2018 and another claim of Rs.66,183/- for hospitalization on November 23, 2018, and also for the compensation of Rs.1,00,000/- for physical strain and mental agony and also for Rs.25,000/- as cost of litigation.
Notice of complaint was given to the OPs and OPs appeared through counsel and also filed reply to the complaint and oppose the complaint. However, during the pendency of the complaint the payment of claims of Rs.60,000/- and Rs.66,183/- was made by the OPs to complainant. In this regard Sh. Kulwinder Singh, advocate, counsel for the complainant made statement through video conferencing that the claims as mentioned in the prayer clause, sub-clause A and B (60,000/- & 66,183/-) have already been paid by the OPs. So, he does not press the complaint for such claims. He only claimed the compensation towards the physical strain and mental agony along with cost of litigations.
We have heard the counsels for the parties and gone through the file.
The amount of claims have been paid by the OPs during pendency of this complaint and earlier the claims were denied by the OPs. So the complainant had no option except to file this complaint and accordingly we find that the complainant must have suffered the physical and mental agony and he also paid some money towards litigation. Accordingly, this complaint is allowed partly and the OPs are directed to pay a sum of Rs.10,000/- to the complainant towards compensation for physical and mental agony and they are also directed to pay a sum of Rs.5000/- towards litigation expenses to the complainant. The compliance of this order be made by the OPs within a period of 60 days on receipt of certified copy of this order. The copy of this order be provided to the complainant and OPs free of cost. The file be return back to the District Consumer Commission, Mohali for consignment.
