Today is fixed for final order.
The case of the Complainant in short is that the Complainant M/S Pataka Industries Pvt. Limited filed the instant case claiming Rs. 2,35,476.50/- together with interest @ of 18 per cent per annum and Rs. 1,00,000/- as compensation for deficiency of service and Rs. 50,000/- as litigation cost.
Ld. Advocate for the Complainant filed a compromise petition on 16.02.2023 along with a power of attorney (E mail) stating that the dispute had been amicably settled at an amount of Rs. 1,96,751/-. The O.P. Insurance Company made an endorsement “agreed” on the said compromise petition.
Heard both sides. Both the parties fairly submitted before this Commission to dispose of the instant case on the basis of the “agreed” amount of Rs. 1,96,751/-.
Considering the facts and circumstances of the case, we think that the instant case should be disposed of as per compromise petition.
The point to be noted is that the compromise petition is legal and vailid and as such it is required to be accepted.
Hence, it is
ORDERED
that the instant case bearing no. CC/104/2020 be and the same is disposed of on the basis of compromise petition.
The O.P.s are directed to pay Rs. 1,96,751/- ( Rupees one lakh ninty six thousand seven hundred fifty one only) to the Complainant as full and final satisfaction.
The compromise petition do form part of the order.
The instant case is thus disposed of.
Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
