The case of the complainant, in short, is that the Op, despite having accepted the requisite fees on account of connection charge, security deposit and earnest money, has not given supply of electricity to the residence of the complainant for which the case has come up before this Forum.
Op-W.B.S.E.D.C.L. contested the case by filing written statement challenging that the case is not maintainable for want of cause of action. Admittedly there held physical inspection for the purpose of giving electricity to the complainant and accordingly work order was sanction in favour of the complainant. Op-W.B.S.E.D.C.L. attempted for erection of line with installation of pole but the work was reportedly stopped due to objection raised by one Sankar Das and others in the locality. Thus, the Op-W.B.S.E.D.C.L. claims that they are not liable for deficiency in service and thereby the case should be dismissed with cost.

Having considered the case of both parties together with their submission supported by relevant document on admission, it appears that the supply of electricity could not be done due

to objection of one Sankar Das on different dates consecutively and as such the supply of electricity has been suspended. Ultimately the complainant was asked for providing possible way leave so that the installation work can be done.
In view of the inconvenience due to alleged local objection and implement in providing electricity line for supply of energy of the complainant, there is no valid evidence forthcoming before us from the end of Op in order to establish the plea. If that be so, the Op-W.B.S.E.D.C.L. cannot waive their liability in providing electricity to the complainant.
Under the facts and circumstances as discussed above, it is held and decided that the Op W.B.S.E.D.C.L. is liable for deficiency in service. Thus, the complainant case should be allowed.
Hence,
It is ordered,
that the case be and the same is allowed on contest without cost.
The complainant Ramesh Ch. Maity is entitled to get electric connection subject to fulfillment of necessary formalities.
The OP W.B.S.E.D.C.L. is hereby directed for providing electric connection to the complainant within thirty days from this date subject to fulfillment of necessary formalities in this behalf.
