          Today when the matter is called out at 12:20 p.m. the Applicant/Appellant as well as counsel for the Applicant/Appellant is absent.  On 3/8/2011 we had directed to issue notice returnable on 14/12/2011 on delay condonation application to the Non-Applicant/Respondent.  However, endorsement made by the office reveals that as the Applicant/Appellant did not come with requisite papers for service of notice to the Non-Applicant/Respondent, notice could not be issued.  On 14/12/2011, Applicant/Appellant as well as counsel for the Applicant/Appellant remained absent.  Last chance was given to the Applicant/Appellant to comply with the earlier order dated 3/8/2011 and the matter was adjourned till today.  Even today no one is present on behalf of the Applicant/Appellant.  Notice on delay condonation application is as yet not issued to the Non-Applicant/Respondent.  Hence, Miscellaneous Application No.316 of 2011 seeking condonation of delay in filing Appeal No.615 of 2011 stands dismissed for default.  Consequently the appeal does not survive for consideration.  No order as to costs.  Inform the parties accordingly.
