Attendance on behalf of complainant has been filed. Heard learned lawyer for the complainant on the point of admission and perused the record.

            The, brief, facts of the  case is that father of the complainant  Late- Vishnath Prasad purchased a tractor bearing no.-BR06D8395  from M/s Shiv Shakti Trader Main Road  Brahamapura, Muzaffarpur in the year 2003 for Rs. 2,99,711/- on loan from Indian  State Bank Agriculture,  Branch Bhagwanpur, Muzaffarpur. The further case is that the  complainant  filed  a petition  before District Transport Officer (o.p.) for obtaining  second copy of owner  book on 13-01-2018 and deposited Rs. 500/- by Challan on 13-01-2018 but o.p. no.-1 refused to entertain  his application,  then the father of the complainant filed the same petition  before establishment office of D.M. Muzaffarpur on 19-02-2018.  The further case is that the complainant  filed an application for  getting information on 03-04-2018 for reply of owner book but o.p no.-1 didn’t reply the same, so the complainant  sent a legal notice to O.P. and filed this case.

            The complainant has filed this case against officer  of Deputy Collector  rank Act of the o.p. against which,   this complaint has been filed comes under the purview  Bihar Lok Shikayat Nivaran  Adhikar Adhiniyam and the information Act 2005, from  which where the proper remedy may be obtained.  But the complainant  has not adopted the above forum, so same is against statutory   law and is not maintainable before this forum.

            In the circumstances, the complaint petition is dismissed at admission stage itself.
