ORDER

Petitioner filed the revision petition before the State Commission challenging the interim order passed by the District Forum Karnal directing the petitioner to deposit the sum of Rs.10,000/- as fee for the Special Officer to be deputed by the respondent to visit to Licensing

Authority, Zunheboto, Nagaland to confirm the status of the license of the complainant.  Petitioner had sent the revision petition by post which was received in the office of the State Commission on 19.12.2011.  On the date fixed, petitioner did not appear.  State Commission dismissed the revision petition in default for non-appearance as well as being barred by time.  There was a delay of 28 days in filing the revision petition for which no application for condonation of delay was filed. 

             Aggrieved by the order passed by the State Commission, present revision petition has been filed.  Limited notice was issued to the respondent to show case to why the delay in filing the appeal be not condoned, impugned order be not set aside and the case remitted back to the State Commission to decide it afresh in accordance with law.

             Respondent, though has been service, is not represented.  Ordered to be proceeded ex parte.

             On an oral request made by the petitioner who is appearing in person, the delay of 28 days in filing the appeal is condoned.  Impugned order of the State Commission is set aside and the case is remitted back to the State Commission to decide it afresh in accordance with law taking the appeal having been filed within time.

             Petitioner is directed to appear before the State Commission on 28.01.2013.

             Copy of this order be sent to the respondent for its information as well as a direction to appear before the State Commission on the date fixed.
