F I N A L O R D E R
1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p. to return the original deed executed on 17-01-2007 and to pay compensation of Rs. 35,000/- for harassment and Rs. 15,000/- as litigation costs as the o.p. in spite of several reminders and visits to his office in a row, the o.p. turned a deaf ear to his request.
2. The o.p., District Registrar, Howrah, in his written version admitted the precarious position over missing of the original deed and stated that the efforts are on to retrieve the deed in question.
3. Upon pleadings of both parties two points arose for determination :
i) Is there any deficiency in service on the part of the O.P. ?
ii) Whether the complainant is entitled to get any relief as prayed for ?
DECISION WITH REASONS :
4. Both the points are taken up together for consideration. Admittedly the contents of the complainant are genuine. The plea of maintenance of thousands of records by the DSR Office is too fragile to merit acceptance. Likewise, the plea of shortage of man- power cannot serve as a solace to the complainant. If the original deed in spite of payment of requisite fees and stamp papers is not supplied to the complainant it amounts to gross deficiency of service and the o.p. being the service provider cannot have any way to escape.
We are, therefore, of the view that this is a fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of.
Hence,
O R D E R E D
That the C. C. Case No. 184 of 2014 ( HDF 184 of 2014 ) be and the same is allowed on contest as against the O.P. with costs.
The O.P. be directed to make over the original deed to the complainant within 30 days from the date of this order.
The o.p. do also pay a sum of Rs. 10,000/- to the complainant as compensation for causing mental pain and prolonged harassment and Rs. 5,000/- as litigation costs to the complainant.
The complainant is at liberty to put the decree into execution after expiry of the appeal period.
Supply the copies of the order to the parties, as per rule.
