None has appeared on behalf of the appellant as well as on behalf of respondent No. 2 inspite of several calls, whereas learned counsel Sh. Ashok Dimri A.D.G.C. (Civil) for respondent No. 1 has appeared.

A perusal of the track report (paper No. 57) depicts that the court notice issued by this Commission has properly delivered on the appellant, but by the service of the notice, the appellant has not appeared before the Commission for hearing.

Hence, in the absence of appellant, the appeal shall stand as dismissed.  No order as to costs.

A copy of the order be sent to the concerned District Commission for perusal and necessary information.

                       File be consigned to the record room alongwith the copy of the order. Original file be sent back to the Commission  concerned.
