            Petition is for refund of amount collected by the opposite parties as per the Provisions of Stamp Act. 2nd and 3rd opposite parties filed version raising the preliminary issue of maintainability. Opposite party contented that opposite parties had discharged his official duty and he neither rendered or hired any service for consideration. So, petition is not maintainable and is liable to be dismissed in limine.
 
            Heard both sides. Petitioner is challenging the order passed by the 2nd opposite party. Order in question was passed by the 2nd opposite party in the capacity as a quasi –
: 2 :
 
judicial authority under the Provisions of Indian Stamp Act. Errors illegality or impropriety can be rectified in an appropriate proceedings envisaged under the statute itself. Fora cannot sit in appeal against the order passed by the authority. In our view the dispute is not a consumer dispute. So petition is dismissed as not maintainable.
