1. Alleging deficiency of service and unfair trade practice the complainants filed this case against the O.Ps for refund of security deposit of Rs.15,700/- alongwith compensation.
2.Shorn of unnecessary details, the brief fact of the case of the complainants is that the complainant. 1 is the President and the complainant No.2 is the Secretary of Shree Durga Biswa No.1 SHG Group. They have deposited Rs.15,700/- with the O.P. on 3.11.2017 as per resolution. Accordingly a pass book has been issued by the O.P. in favour of the complainants. After deposit of Rs.15,700/- the O.Ps should provide loan to the complainant. Instead of doing that the O.Ps have closed their office without intimating the complainant. In this connection, the complainant approached the O.Ps for refund of amount deposited with interest, but the O.P.No.2 did not listen. The complainant filed a pass book vide NO.51667 (Code No.04829) where deposit of Rs.15,700/- on 3.11.2017 is mentioned.
3. On being noticed, the O.Ps did not appear and they are set-exparte.
4.The point for determination of the case is whether the complainant is a consumer against the O.Ps and whether the O.P caused any deficiency of service and unfair trade practice against the complainants.
5.The complainants are consumer under C.P.Act.On being approached the O.Ps did not listen to them and they have closed their Branch office.
Taking into consideration of the case of the complainant and document filed by them, we direct the O.P.No.2 to refund Rs.15,700/-(Rupees fifteen thousand seven hundred )only with 6% interest per annum till realization from them alongwith Rs.500/-(Rupees five hundred )only towards compensation and cost of litigation to the complainant within one month from the date of this order, failing which the complainant is at liberty to take steps against the O.P.No2 for realization of awarded amount.
