Order no. 11 dt. 16/12/2013.

          Record is put up for order in respect of the petition dt.23.8.13 filed by o.p. challenging the maintainability of the case.

          We have gone through the record and the petition challenging the maintainability of the case in particular and objection filed thereto.

          In view of the decision of the Hon’ble Supreme Court of India published in A.I.R. 2010 S.C. 90 in Civil Appeal no.7687 of 2004 in the matter of General Manager Telecom  vs.  M. Krishnan & another and also judgment of Hon’ble National Commission passed in R.P. no.1703/2010 the instant case cannot be entertained by this Forum.

          Thus the petition dt.23.8.13 is allowed and as such, the case is not maintainable. Thus the petition is disposed of.

          Complainant is at liberty to agitate the issue before the appropriate Forum on the self same cause of action.

          Plain copy of this order be supplied to the parties free of cost.
