(1)     We waited for applicant/appellant from 12.00 p.m. and it was kept back till 3.15 p.m.  However, neither the applicant/appellant nor his advocate turned up.  Adv.L.N.Karde files vakalatnama for the respondents.  It is taken on record. 

(2)               This is an appeal remanded back by the National Commission vide their order dated 08/11/2012 allowing the revision petition No. 3307/2012 and setting aside the order dated 03/03/2012 of this Commission.  The said order was passed by this Commission on account of absence of the appellant as well as for want of removal of objections.  After remand also, the applicant/appellant is not punctual and today also he remained absent.  This reflects the attitude of the applicant/appellant.  Applicant/Appellant anyhow wants to protract the litigation.  In view of the aforesaid facts, the misc.application No.391/12/ stands dismissed for non-prosecution. In the result, the appeal No.RBT/FA/12/1060 is not entertained.
