Sh.Jatin Sharma, complainant filed the present complaint stating therein that he is having Active Dish TV connection ( old VC No.01512353430 ) and new VC No.02541807647. He received a telephonic message from the opposite party that for their old customers, they have come up with a new offer and that is to replace the old standard set top box with new HD set top box for Rs.399/- only and enjoy HD facility. They also told that on recharge for 6 months, additional 6 months free subscription of the channels i.e.6+ 6 offfer will be given which the complainant accepted. It is further stated that on 9.1.2019, complainant paid Rs. 399/- and got standard set top box with new HD set top box and after changing the set top box, he called Dish TV customer care Executive to get the confirmation about 6+6 offer but they denied the same. Complainant made so many complaint with the opposite party but to no effect. Hence, this complaint seeking directions to the opposite party to give 6+6 offer which promised by them. He also demanded compensation and litigation expenses.
Sh.Talwinder Singh,Adv.appeared on behalf of the opposite party and got recorded his statement that opposite party is ready to compromise with the complainant and in lieu of compromise, opposite party is ready to give 6 months extension to the HD set top box free of costs.
Complainant has stated at bar that he has been harassed by the opposite party for about six months and is entitled to compensation and costs. Perusal of the complaint case shows that he changed his old set top box with new HD set top box in the month of January 2019 but the additional 6 months free subscription i.e.6+6 offer has not been given by the opposite party.
In our considered view, complainant has been harassed by the opposite party. As such, complaint is allowed and the opposite party is directed to pay compensation of Rs.2000/- and litigation expenses of Rs.1000/- to the complainant. Compliance of the order be made within 30 days from the date of receipt of copy of order; failing which proceedings u/s 27 of the Consumer Protection Act shall be initiated against the opposite party. Copy of the order be furnished to the parties free of costs. File be consigned to the record room.
