The Misc. Application dated 02/11/2022 filed by the complainants/petitioners on the prayer of appointment of Engineer Commissioner to hold local inspection of the flat in question is taken up for hearing.

No written objection filed by the opposite parties.

Ld. Advocate for the opposite parties submits that she has no objection against the prayer of the complainants/petitioners.

For proper adjudication of the dispute between the parties, the Misc. Application dated 29/09/2022 is allowed on consent without any cost.

Upadhyay, Engineer Commissioner of 162/A/66, Lake Gardens, Kolkata – 700045, Mob. no. – 9830134750, E-mail ID – upadhyay.sudip1@gmail.com is hereby appointed for local inspection of Schedule –A and Schedule - B property on the point nos. I to XIX mentioned in Page No. 6 of the Misc. Application.

Complainant is directed to pay fees of Rs. 10,000/- only to the Engineer Commissioner and to submit the receipt of payment in CC/186/2021 by 27/02/2023. Thereafter, writ will be issued.

Complainant is directed to serve the copy of Misc. Application along with relevant documents to the Engineer Commissioner on issuance of writ.

Thus, the Misc. Application No.150/2022 is disposed of.
