1.    None for the appellant is present. Adv.Ruturaj Patil for the respondents is also absent. On 20/07/2013  fresh notice was issued to the appellant as well as respondent and their respective   counsel but no report about service of notice is received. The office copy of the notice reflects that the notice was issued on the correct address of the appellant as well as respondents as shown in the appeal memo. Therefore, it will have tobe presumed that they are  served with notice but nobody turned up. Therefore,  there is no alternative except to dismiss the appeal in default.

 2.       However, we have gone through the copy of impugned judgment and order, copy of complaint and written version and we find that the impugned judgment and order is just, proper and legal. Hence on any count the appeal deserves to be dismissed and accordingly it is  dismissed. No order as to cost.
