Today is fixed for MA/144/2022 hearing and it is taken up for hearing.

Heard the Ld. Advocates on both sides.

By filing the aforesaid application the complainant sought for an order of injunction in respect to the flat in question. The application is opposed by the Ld. Advocate of the OPs mainly on the ground that refund would be made in compliance with the terms of agreement and according to him there is no need to issue injunction order in respect to the aforesaid flat.

The Ld. Advocate appearing for the complainant prays for injunction order on the ground that the OPs are very much prone to dispose of or alienate the property in suit in favour of the third party. Considered. There should be an order in the form of injunction in respect to the property in suit for the interest of justice. All the parties of this case restrained from dealing with the property in suit so as to frustrate the prayer of the complainant.

The MA/144/2022 is thus disposed of.

The Ld. Advocate of the complainant is directed to complete the service of notice upon OP no. 2-10 by the next date and asking them to file W/V within 30 days from the date of receipt of the notice.

As such, 03.02.2023 is fixed for S/r and appearance of OP no. 2-10.
