Order No.9 dtd.15.12.2017

                         Complainant being present filed hazira. Heard the ex-parte submissions. It is the case of the Complainant that, he purchased a Plot bearing Plot No. 159/484, Khata No.1041/1148, area 1200 sq. ft., Mouza- Agrahat, Ps- Chouduar, Dist.- Cuttack by executing a saledeed and on payment of consideration to Op- Developer. It is further submitted that Op-Developer was paid Rs. 7000/- towards conversion of the said land to homestead land in existing kisam of Agricultural land and did not converted the said Plot to homestead land till-date.

                          Considering the submission and on perusal of attested copy of R.O.R., copy of payment receipts and leaflet we, as-certain, that the allegation of the Complainant is a fact and the dispute is non-rebuttal in nature. Hence, we held, Op-Developer is deficiency in service and accordingly directed that Op-Developer will convert the aforesaid land into homestead and will provide a fresh R.O.R.  in this effect to the Complainant without charging any extra cost within 6(Six) month of receipt of this order, failing which action will be initiated as per the provisions of C.P.Act,1986.                                    

                          Accordingly, the Complaint is allowed in part on ex-parte without cost.
