Final Order / Judgement

Today is fixed for ex parte hearing. Examination-in-chief which was filed on 07/08/2019 is tendered. Heard the Ld.Lawyer. Order is passed accordingly.

The fact of the case is that the complainant is a retired School Teacher, aged about 63 years. He invested money to the company of O.P. i.e. URO Infra Reality India Ltd. a company incorporated under the Company’s Act, 1956 bearing CIN No. U70109WB2009PLC140503 to the tune of Rs. 70,000/-(Rupees Seventy Thousand Only) and the date of deposit was 30.04.2011 and redemption date is 29.04.2016.  But after the expiry of redemption date the amount has not been paid by the O.P. company to the complainant. The complainant several times requested the company to make the payment but ultimately there was no fruitful result as such the complainant has come to the Forum regarding the deficiency of service on the part of the O.P. Company.  The evidence adduced by the complainant remains unchallenged. On perusal of the evidence adduced by the complainant and on perusal of the documents the complainant has been able to prove the case ex parte. So the complainant is entitled to get relief. 

                                                                                 

C.F. paid is correct.

 

Hence ordered that

                            

the case be and same is allowed ex parte against the O.Ps with cost. The complainant gets Rs.70,000/- (Rupees Seventy Thousand Only) which he deposited to the O.P. Company on 30.04.2011 along with the maturity value over the Rs. 70000/- (Rupees Seventy Thousand Only) till the date of payment. The complainant also gets Rs. 20,000/- (Rupees Twenty Thousand Only) as litigation cost and Rs. 25,000/- (Rupees Twenty Five Thousand Only) for mental pain and agony and harassment.

 

The O.Ps are directed to make the payment of the aforesaid amount as ordered within 45 days from the date of order failing which it will carry an interest @ 5% p.a. over the calculated amount as ordered above  from the date of filing of the case. The O.P. Nos. 1 and 2 are jointly and severally liable to make the payment. In the case of non-payment of the aforesaid amount the complainant will be at liberty to put the decree in execution.  

Let a copy of this order be given to the parties free of cost.
