The Complainant is present in person. Today is fixed for admission hearing of the complaint.
At the time of hearing it is noticed by us that complainant has prayed for refund of the paid amount from the Op, which was paid to the Op at the time of admission. It is also admitted by the Complainant that after getting admission class had been started and the complainant attended the classes for two days or more. According to the Complainant as the Complainant understood that the score will not be helpful to him, he decided to left the scores and in this regard he contact with the Op through telephonic calls, electronic mails and messages, to no effect. As the Complainant did not get refund of the amount for a prolong period, he issued legal notice to the Op, but did not get any reply from the Op till filing of this Complaint. As the Op did not take any step for redressal of his grievance, hence this complaint initiated by the Complainant against the Op praying for refund of the paid amount.
Upon careful perusal of the petition of complaint, other related documents and hearing the Complainant in person, it is noticed by us that the complainant did not adduced any corroborative documents in support of his contention which permits him for getting refund of the paid amount.
Be it mentioned that no brochure/prospectus is filed by the Complainant to show that there is provision for withdrawal of the paid amount after joining the class, in case of any problem or dissatisfaction until and unless the same is produced before us, we are not in a position to hold that there is deficiency in service on behalf of the Op in providing educational service to this Complainant.
In view of the above discussion it is ordered that CC/106/2021 is hereby dismissed without being admitted. There is no order as to costs.
As the complaint is not admitted the Complainant is also at liberty to get return of the copy of the compliant and copies of the related documents from the office of this Commission and in this respect he is directed to submit a separate application to the appropriate authority of this Ld. Commission praying for getting return of the abovementioned documents. The appropriate authority of this Ld. Commission is hereby directed to provide the Complainant the copy of the Complaint and the related documents as aforementioned without any further delay upon receipt of the application from the complainant.
Let plain copy be given to the parties free of cost as per CPR.
