Notice issued against opposite duly served vide potal acknowledgment. Dealer sales manager of opposite Bhagyodaya's Trocos Private limited Hospet, present and submitted that, he is ready to make the payment and accordingly he has submitted cheque bearing No. 171043 of HDFC Bank, Sindhanoor dt. 08-12-2011 in favour of complainant for an amount of Rs. 8000/- the complainant prsent and filed memo stating that, his claim  has been settled and accordinlgy Rs. 8000/- through above said cheque and Rs. 1000/- byhand in cash and further submitted t close the complainant accordingly hence in view of the memo dt. 09-12-11 the complaint of the complainant is hereby dismissed as not pressed.
