Brief Facts of the case  

The complainant purchased a new symphony Cooler, Jumbo Jr. Sr. no.- 05A0913E54143 for Rs 6500 vide invoice no. 1116 on 20/05/2014. The said cooler developed problems in water pump after second month of purchase.

Complainant gave six complaints to OP 2, but did not get any response or service, so gave legal notice for refund of product cost. No reply was given by OP2.  Hence, filed this complaint and claimed for refund of cooler cost Rs 6500, compensation Rs 7000/- and cost of litigation Rs 3000/.  

Complaint was scrutinized and annexures seen. Notice was served to both OPs. Despite of service, no one put its appearance or filed their written submission and evidences. Despite of giving ample opportunity, case was preceded Ex Parte.

Complainant filed his Ex Parte evidences on affidavit and are on record and not controverted.

We took merit of the case and evidences on affidavit, allowed complaint and

pass the following order as -

Opponent is directed to refund the cost of the product with 9% interest from the date of filing of this complaint till realization.

We also award compensation and litigation charges to a sum of Rs 3000/- for mental agony, pain and harassment caused to complainant due to his deficient services. This amount will be paid within 30 days from the receiving of order. 

The copy of this order be sent to the parties as per rules and file be consigned to the record room.
