Final Order / Judgement
  1. Today is fixed for admission hearing .
  1. After hearing the Ld. Advocate of the complainant and perusing the material available on record it is found that for installation of a modular kitchen payment of Rs. 70,500/-  + Rs. 85,000/- was made by the complainant in favour of the OPs in December, 2019 and January/February of 2020.
  1. As the aforesaid work was not up to the liking of the complainant the complainant lodged complaint on 01.03.2020 with the customer care of the OPs, but in vain.
  1. But for direction to the Op for payment of Rs. 70,500/-  in favour of the complainant this case has been filed ignoring the amount mentioned in the Para 12 of the complaint i.e. Rs. 85,000/.
  1. The complaint states that two cheques amounting to Rs. 85,000/- which were issued by the complainant have not yet been encashed by the OPs. Possibly he has wanted to say that since the cheques of Rs. 85,000/- have not been encashed, the complainant has abstained from seeking any direction there for.
  1. He has neither stopped the payment of Rs. 85,000/- under the aforesaid cheques nor he has sought for any direction for refund of the said amount. The case appears to be premature one and misconceived one. The case, as framed, we think, is not at all maintainable. The complainant has wanted to launch a never ending process which this Commission should not encourage.

          Hence, it is ordered the case be and the same is dismissed as being not admitted.

          Let plain copy be given to the parties free of cost as per C.P.R.
