Final Order / Judgement

 Complainant is absent. None present on his behalf.

            This case is fixed for hearing on the point of admission. Perused the record.

            The brief, fact of the case is that the complainant got enrolled his son Gaurav Kumar aged  about 11 years in the Laskh School  Residential (o.p) in healthy  condition on 27-03-2018. The further  case is that  he used to pay the monthly fee of the school. The further case is that on 08-12-2018, he went at school on phone and met with his son in the hostel. The further case is that he found that his son was physically  & mentally   ill and on search he found that due to  undue care of the  Teacher  of school and hostel,  he became mentally  ill. The further case is that he consulted with expert doctor  of mental disease who advised that due to negligent  Act of school and hostel,  the student became ill.

            The complainant  has filed annexure 8 and  9 with  prescriptions of Dr. Prakash Kr Sinha and Dr. Sanjay Kr. Sinha. On  perusal of  annexure-8, it  appears that after consultation  on 08-12-2018, some medicines   were  provided and on  17-12-2018 the condition of the patient  has become better.  During  the course of hearing the complainant was directed to file expert opinion on the point  to  substantiate that Gaurav Kumar is mentally ill due to torture of teacher of school & Hotel.   He has only filed the photocopy of  prescription of Dr Sanjay Kr dated 15-06-2019. There is difference between  annexure-9 and  another photocopy copy of the same. In another copy, it has been   mentioned that he was referred  to higher centre condition.

          The complainant has not filed any expert opinion on the point that during period of lodging  in the hostel, the students suffered with mental disease, and as such there is no evidence, prima facie, on record to prove that there is deficiency in service on part of o.p. In the circumstances the complaint is dismissed at admission stage, itself.
