            The case of the complainant is that he had purchased a ticket from Kerala State Road Transport Corporation Reservation Counter for Rs.630/- to travel from Bangalore to Kozhikode, on 14.6.2008 at 10.30 P.M.  After receiving the ticket he along with his friend waited at Bangalore boarding point platform No.6/7 as per direction from K.S.R.T.C.  Complainant waited there till 11.30 P.M.  But the said bus did not reach the boarding station.  After that he came to know that the said bus started journey from the nearby road margin.  That was not intimated to the complainant when he enquired about the bus.  Due to this negligent act of the opposite parties, complainant was forced to travel by another bus, at about 11.30 P.M. by giving separate charge.  By non-reservation, complainant suffered great loss.  Hence he is seeking relief against the opposite parties for refund of the ticket charge and also a compensation of Rs.2000/-.

 

            Opposite parties after serving notice entered in appearance and filed version, denying all the allegations made by the complainant.  It is admitted that on the very same day, the bus could not reach the boarding station in the stipulated time due to heavy traffic.  When the case was specifically posted for evidence on 13.2.2009, opposite party called absent and set exparte.

 

            Complainant was examined as PW1 and Exts. A1 to A4 were marked.

 

            From the evidence and Exts. A1 to A4, complainant’s case is proved.

 

            Therefore, petition is allowed and the opposite parties are directed to pay an amount of Rs.2630/- with a cost of Rs.250/- to the complainant.

 

            Pronounced in open Court this the 17th day of February 2009.
