This record is placed before the Ld. Bench in view of the put up petition filed by the OPs by filing MA being no. MA/13/2022.
In the application the OPs have prayed for put up this record before the Ld. Bench for proper adjudication and the OPs have also submitted that they have willing to file W/V as well as cost before this Ld. Commission in view of the order passed by the Hon’ble SCDRC in the Revision Petition No. RP/176/2018.
Be it mentioned that being aggrieved with the order passed by the Ld. Barasat Commission dated 06.08.2018 the OPs have referred the above mentioned Revision Petition before Hon’ble SCDRC. On 31.12.2021 the Hon’ble SCDRC has been pleased to dispose of the said Revision Petition directing the OPs to submit W/V by 31.01.2022 along with payment of cost of Rs. 12,500/- (including arrear).
In the said order Hon’ble SCDRC has been pleased to mention that the sum of Rs. 7,500/- shall be credited to the complainant by the OPs. Therefore the balance amount of Rs. 5,000/- shall be paid to the Consumer Legal Account by the OPs.
We have carefully perused the order passed by the Hon’ble SCDRC. The OPs are directed to pay the sum of Rs. 7,500/- to the complainant by way of demand draft and the balance amount of Rs. 5,000/- shall be credited in the fund of Consumer Legal Account by way of demand draft positively on 31.01.2022 .
Today the OPs are inclined to file W/V, but upon going through the same it is detected that the W/V suffers from some technical mistake. Notary did not put endorsement on each and every pages of the W/V.
Fix 31.01.2022 for filing W/V by the OPs in a proper manner and payment of cost as mentioned above without any fail.
With the above mentioned order the MA/13/2022 is thus disposed of.
Let plain copy be given to the parties free of cost as per CPR.
