JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

The appellant is the opposite party/Oriental Insurance Company in CC.116/08 in the file of CDRF, Ernakulam. The appellant is under orders to pay the assured amount to the complainant with interest at 12%. The mediclaim of the assured for the treatment undergone was rejected on the ground that during the first year of the policy Polycystic   ovarian   diseases are excluded. It was mentioned that the complainant had policy coverage on a near to year basis from 17.10.03 to 16.10.07 with New India Assurance Company Ltd. After her marriage the current policy with the appellant commenced from 17.9.07 ie; before the expiry of the earlier policy from New India Assurance Company Ltd. Although, the complainant had continuous policy coverage it is the contention of the appellant that the policy with the appellant/company ie; Oriental Insurance Company will be treated as a fresh one and that the policies from 17.10.2003 with the New India Assurance Company Ltd. will not be taken into consideration. The Forum below rejected the above contention holding that the appellant and the New India Assurance Company are constituted and controlled by the General Insurance Corporation and hence the stand taken by the opposite party cannot be upheld. We find that the finding of the Forum is very much in the correct lines. There is no illegality in the order of the Forum.
          2. We find that there is no scope for admitting the appeal. The appeal is dismissed in limine.

The office is directed to forward the copy of this order to the Forum urgently.
