This order has arisen out of a petition under XXXIII Rule (I) if Civil Procedure filed by the complainant praying for allowing him to withdraw the case to file a fresh case against the OP Dilip Tayung and others waiving her right to claim relief before 8.7.2002 which is beyond the period of limitation as per provision of Consumer Protection Act.

                              Heard both the sides in presence of ld. members. Since the complainant is wiling to file fresh petition for the period covered by limitation, she is allowed for the withdraw the petition in order to file a new petition.

                                 This petition is disposed of on withdraw.
