JUDGMENT

 

JUSTICE SRI.K.R.UDAYABHANU  : PRESIDENT

 

 

          The appellant is the opposite party in OP.157/02 in the file of CDRF, Ernakulam.  The appellant is under orders to pay a sum of Rs.10,224/- with interest at 10% per annum from the date of this complaint and cost of Rs.1000/-.

          2. The matter relates to the alleged low quality of the paint manufactured and supplied by the opposite party.

          3. The evidence adduced consisted of the testimony of  PWs 1and 2 and DW1; Exts. A1 to A6 series.

          4.  The respondent/complainant stood ex-parte before this Commission.

          5. We find that the Forum has disposed of the matter by a cryptic order without discussing the evidence adduced in the matter.  Hence the order of the Forum is set aside.  The matter is remitted back to the Forum below and it will dispose    of the matter afresh after issuing notice to the complainant.  The parties will be at liberty to adduce further evidence if they so desire.

          6. The case stands posted before the Forum on 14.9.2010.

          Office will for ward the LCR along with the copy of this order to the Forum urgently.
