          The case is taken up for hearing. But on repeated call it appears that the complainant is found absent without steps. Now it is 1:00 p.m.

 

          On a close scrutiny of the materials on record it appears that since inception the complainant is found absent. Under such circumstances as direction of the C.P. Act let us considered and decided the matter on merit.

 

          The case of the complainant is that he was approached by the O.P by means from the opposite party. On the basis written agreement dated 09.03.2021. Being convenience the complainant purchased the machine from the AP and on demand of same of Rs. 304000/-  payment  made on different dates. But on receipt of the amount in full the O.P denied to hand over the key the ATM machine to the complainant. Hence this case. But inspect to file the petition of complaint the complainant fail to take any necessary steps by appearing before this commission in order to prove his case beyond all reasonable doubt even after get several opportunities. Under such circumstances the conduct of the complainant shows that he is not interested at all to establish his case by appearing before this commission on the basis of cogent evidence. Without having any cogent evidence from the end of the complainant this commission has no option to continue the case of the complainant. Thus the commission is in view the complainant failed to prove his case beyond all reasonable doubt. Thus, the petition of complaint has filed by the complainant is considered and dismissed on merit.
