Learned counsel Smt. Shashi Yogeshwar for the appellants as well as learned counsel Sh. K.K. Tripathi for respondent have appeared before the Commission.
Learned counsel for respondent has moved an application (paper No. 30) stating that his complaint be referred to CGRF, Haldwani for disposal.
The above mentioned application is not opposed by the appellants counsel.
We have perused the memo of appeal and heard the learned counsel for both parties.
Appellants have specifically alleged in para Nos. 14 & 15 of the memo of appeal that learned Forum has wrongly not considered it proper to refer the dispute to CGRF which is statutory remedy provided under Section 42(5) of the Electricity Act, 2003 and it is further stated in the grounds of appeal that there is any error or grievance of the consumer, in regard to the electricity bill, the law has established the CGRF for the resolution of electricity disputes.
As per the application submitted on behalf of the respondent, the appeal is hereby allowed acocrdingly and the complaint shall stand as dismissed with no order as to costs.
The respondent – complainant is directed to file fresh complaint before the CGRF, Haldwani under Section 42(5) of the Electricity Act, 2003 for getting remedy against his alleged grievance at his discretion.
File be consigned to the record room.
The copy of the order be forwarded to the concerned District Commission for information and necessary action.
