Sri O P Srivastava, learned Counsel for the revisionist appeared.
I have heard learned Counsel for the revisionist and perused impugned order dated 28-10-2018 passed by District Consumer Forum, Varanasi in Complaint Case No. 46 of 2017 Dhirendra Kumar Singh V/s Fry-Bake Food Equipments whereby the District Consumer Forum has rejected application moved by revisionist with prayer to recall order dated 25-08-2018.
The District Consumer Forum has held that the District Consumer Forum has no power to recall its order passed earlier. As such the application moved by revisionist with prayer to recall exparte order

passed earlier is against law.
In view of proposition laid down by Hon’ble Apex Court in the case of Rajeev Hitendra Pathak and others V/s Achyut Kashi Nath Karekak and another reported in IV(2011) CPJ 35(SC) the view expressed by District Consumer Forum cannot be said to be against law.
In view of above present revision petition is dismissed with liberty to revisionist to seek proper remedy against exparte order dated 25-08-2018 passed by District Consumer Forum in above complaint.
Let copy of this order be made available to the parties positively within 15 days as per rules.
