Heard on the application for dismissal of complaint for want of cause of action and being time barred. The counsel for OPs filed this application for dismissal of complaint on the ground of limitation and for want of any cause of action. The complainant filed this complaint for grant of horticulture tubewell connection which was applied on 05.09.2008. According to the OPs the connection could not be issued as the complainant failed to deposit the security as per demand notice of the opposite parties dated 2^nd April 2009 and the departments has also sent the reminder on 20^th October 2009 and closed the file on 16.12.2009. The perusal of case file reveals that the complainant only on 07.08.2010 requested the opposite parties for issue of his connection. However there is nothing on file that thereafter also he approached to the OPs in this regard and after the lapse of 15 years the complainant has filed this complaint. Since the complainant himself failed to deposit the security amount as per demand notice issued by the opposite parties and filed this complaint after 15 years, therefore the present complaint is time barred and without any cause of action and the same is hereby dismissed. File be consigned to record-room after due compliance.
