ORDER

Alongwith the appeal, an application for condonation of delay of 40 days as per the applicant/appellant  (as per the office report 16 days), in filing the appeal, has been filed.

                   Heard.

                   For the reasons stated in the application, which is supported by a duly sworn affidavit and finding sufficient cause, the delay aforesaid is condoned.

                   The application is disposed of accordingly

                   On 30.05.2017 the following order was passed by this Commission:-

                     “As per office report, the record of the District Forum has been received.

                        Alongwith the appeal, an application for condonation of delay of 40 days as per the applicant/appellant  (as per the office report 16 days), in filing the appeal, has been filed.

                        At the time of hearing, Counsel for the applicant/appellant confined his prayer only to the extent of grant of compensation of Rs.7,000/-, stating that it is on the higher side.

                        Let notice of the application for condonation of delay, as also of the main appeal be issued to the respondent for 22.06.2017.

                        Dasti also."

                   This Commission was not going to interfere on merits. At that time, faced with that situation, Counsel for the appellant/Opposite Party restricted his prayer only to the grant of compensation stating that it is on the higher side.

                  

                   At the time of arguments, the respondent/complainant has put in appearance and very fairly stated that let the amount awarded be reduced to Rs.4500/- .

                   We appreciate the stand taken by the respondent/complainant and we feel that the amount will be reasonable to compensate the respondent/complainant.

                   In view of above, this appeal stands disposed of.

                   The appellant/Opposite Party is directed to pay the aforesaid amount within 10 days from today through demand draft to the respondent/complainant, failing which, the respondent/complainant shall be entitled to get interest @7% p.a. till the time of making the payment.

                   Certified copies of this order be sent to the parties free of charge.
