FINAL ORDER/JUDGEMENT.

Complt files hazira through Ld. Advocate Somnath Guin. The case is fixed for exparte hearing. No step is taken by the O.P / builder who is found absent on repeated calls. The Complt. initially entered into an agreement on 30.08.2017 for purchase of a residential flat for Rs. 17,00,000/- out of which an earnest money of Rs. 4,00,000/- has been paid to the O.P under proper receipt. Subsequently that project was cancelled and the O.P entered into a fresh agreement on 03.04.2019 for purchase of a residential flat for the same consideration money on the assurance that the advance money of Rs. 4,00,000/- will be adjusted. O.P / Builder did not complete the apartment within the stipulated period as per terms and condition of the agreement of sale nor refunded the advance money despite several reminders and persuasion.
The complt. has therefore approached this Commission for appropriate relief.
Perused the petition of the Complt. and the relevant documents on record. Prima-facie case is established. The O.P builder having failed to deliver the flat as agreed upon the Complt. is entitled to get the refund of the earnest money.
The case therefore succeeds exparte.
Hence it is,
Ordered.
that the case be and the same is allowed exparte against O.P / Builder without cost. O.P./builder is directed to pay to the Complt. Rs. 4,00,000/- with litigation cost of Rs. 25,000/- within a month from this date in default law will take its own course. Let a plain copy of this order be given to the parties free of cost.
