ORDER

1.   Vide his separate statement, Sh.Gurlal Singh, Complainant in person has stated that the matter has been settled with OP No.1 & 2 and as per settlement, he will make the payment of Rs.40,000/- in lumpsum to OP No.1 & 2 as full and final settlement in respect of loan account Nos.IPERCHA03759990, IDHADEL08974371 & IPERCHA08449845 in three installments, i.e. first installment of Rs.14,000/- will be paid by him on or before 25.05.2024; second installment of Rs.14,000/- will be paid by him on or before 25.06.2024 and third/last installment of Rs.12,000/- will be paid by him on or before 25.07.2024. It has been further stated by complainant that in case of any default in aforesaid payment, the defaulted amount shall be paid by him alongwith interest @ 12% p.a. from the date of default. It has been further stated by complainant that after making the aforesaid payment, OP No.1 & 2 will issue No Due Certificate to him qua the above said loan accounts and prayed that the complaint be disposed of in terms of aforesaid settlement against OP No.1 & 2. The complainant has also prayed that at this stage, he may be allowed to withdraw the present complaint against OP No.3 with liberty to file separate complaint against OP No.3 on the same cause of action. Vide his separate statement, Sh.Dharam Singh, Collection Manager of OP No.1 & 2 has admitted the aforesaid statement of complainant.

2.   In view of the statements of the parties and in terms of the settlement, the complaint stands disposed of by passing the following order:-

  1. The complainant will make the payment of Rs.40,000/- in lumpsum to OP No.1 & 2 as full and final settlement in respect of loan account Nos.IPERCHA03759990, IDHADEL08974371 & IPERCHA08449845 in three installments, i.e. first installment of Rs.14,000/- will be paid by complainant on or before 25.05.2024; second installment of Rs.14,000/- will be paid by complainant on or before 25.06.2024 and third/last installment of Rs.12,000/- will be paid by complainant on or before 25.07.2024.
  2. In case of any default in aforesaid payment, the defaulted amount shall be paid by complainant alongwith interest @ 12% p.a. from the date of default.
  3. After receiving the aforesaid payment from the complainant, OP No.1 & 2 will issue No Due Certificate to the complainant qua the above said loan accounts.

 

3.   The present consumer complaint is dismissed as withdrawn against OP No.3 with liberty to file separate complaint against OP No.3 on the same cause of action, as admissible under the law.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
