1. The instant complaint has been filed by the complainant, wherein she has alleged that she was in search for a suitable job with handsome salary for her husband Sourabh Sharma on various job site for example Quiker Jobs during the month of December, 2020. That the officials of Dezire Consultants informed her through mobile that they are the job/service providers and asked her to contact them in their office for providing the job to her husband. She alongwith her husband visited their office as mentioned above at OP No.1 for the purpose and they asked them to deposit Rs.1000/- as registration fee and Rs.6000/- as advance payment for providing job within 15 days as required by us. She made payment of Rs.1000/- to HR Deepali Khosla via Google Pay on 02.12.2020 at 06:14 PM. That another payment of Rs.2000/- paid on 11.12.2020 to HD Deepali Khosla via Google Pay. That Rs.4000/- was given in cash to HR Deepali Khosla after few days. That they have not provided any suitable job as discussed so far. They only referred to her husband to meet Mr.Uttam Sir of HDFC Bank Industrial Area, Jalandhar on 30.12.2020, who was not any competent official of HDFC Bank to providing any job and not for taking any interview. He (Uttam Sir) told us that her husband is over age bank job and only young ones are required. So, in this way they misguided us and did not perform any service. On informing them about above they again asked to contact Krome Dispense Marketing Manager, D-74, Krome Dispense Private Ltd., Focal Point Extension, Jalandhar. She visited there, but no response was given by them, providing the reason that they want only sales person. So, again the agency misguided and not fulfill their task for which they received payment. They also told them to contact Mr.Deepak from IDBI Bank for providing the job to her husband. As they met him, but he refused to recognize the HR Deepali Khosla. Inspite of above, she contacted the owner of the agency i.e. the HR and other employees of the agency and also visited their personally for providing job to her husband, but all in vain and as such, necessity arose to file the present complaint with the prayer that the complaint of the complainant may be accepted and OPs be directed to refund her amount of Rs.7000/- with interest @ 9% per annum alongwith suitable compensation.
2. Notice of the complaint was given to the OPs, but despite service all the OPs did not come present and ultimately, all the OPs were proceeded against exparte.
3. In order to prove his respective version, the Auth. Representative of the complainant produced on the file his respective evidence.
4. We have heard the Auth. Rep. of the complainant and have also gone through the case file very minutely.
5. The complainant has alleged that she had contacted M/s Dezire Consultants/OP No.1 for providing a suitable job to her husband. As per documents produced on the file by the complainant, it is clear that M/s Dezire Consultants deals in Training (Banking, Finance, IELTS, English Spoken Classes & Interview Preparation etc.) & Recruitment in all Sectors (Banks, Hospitals & Other Companies). The complainant has alleged that she had made a payment of Rs.7000/- (Rs.1000/- as registration fee and Rs.6000/- as advance payment for providing job within 15 days) and since no job has been provided to her husband. She has asked for refund of Rs.7000/-.
6. The complainant has produced on the file photocopy of payment via Google Pay of Rs.1000/- on 02.12.2020 as Ex.C-1 and Rs.2000/- on 11.12.2020 as Ex.C-2. The complainant has further claimed that she had made a payment of Rs.4000/- in cash after few days and has claimed the photocopy of payment in this respect enclosed as Ex.C-3, whereas Ex.C-3 is a document of terms and conditions of the Dezire Consultants and it is not a receipt as claimed by the complainant. Therefore, this claim of the complainant is not acceptable.
7. As per terms and conditions of the agreement Ex.C-3 the complainant was supposed to deposit Rs.6000/- as registration fee, whereas she deposited only Rs.3000/- (Ex.C-1, Ex.C-2). While going through the documents attached vide Ex.C-4 to Ex.C-16, it is clear that OPs have sent the resume of complainant to many companies and interviews were also held in some cases. So, we do not find any deficiency in service on the part of the OPs and thus, the complaint of the complainant is dismissed with no order of cost. Parties will bear their own costs. This complaint could not be decided within stipulated time frame due to rush of work.
8. Copies of the order be supplied to the parties free of cost, as per Rules. File be indexed and consigned to the record room.
