ORDER

Complainant present. Sri I.M. Devaiah, Advocate files vakalath for opposite party and opposite party presented a cheque for Rs. 4,100/- which is payable to the complainant. The complainant has filed his complaint seeking refund of Rs. 5,515/- paid to the opposite party towards processing fee for sanction of loan. Since the opposite party has not finally sanctioned the loan and loan has not been disbursed to the complainant, the complainant has sought refund of Rs. 5,515/- paid to the opposite party. In response to the complaint the opposite party today appeared through counsel and submitted a cheque in the name of complainant for Rs. 4,100/- in full settlement of the claim. It is just, fair and proper to permit the opposite party to retain Rs. 1,415/- towards miscellaneous expenses. Therefore, it is just, proper and reasonable to direct the complainant to receive cheque for Rs. 4,100/- which has been presented by the opposite party in full and final settlement of the claim. In view of deposit of cheque by opposite party the matter is closed as settled. Office is directed to hand over the cheque to the complainant after obtaining signature on payment voucher. Order accordingly, President I concur the above findings. MEMBER
