None for appellant is present. Its counsel Mr. Wankhede as well as Mr. Jadhao are also absent. The record reflects that the appellant as well as his counsel are absent since long. Therefore, notice by RPAD was issued to the appellant. Even then none for appellant is present. Mr. Bapat appearing for respondent No.1/original complainant submitted that the respondent No. 2 - bank had paid decretal amount to the complainant in execution proceeding and therefore, it appears that the appellant is not interested to proceed with this appeal. Hence, the appeal is dismissed in default. No order as to cost.
