The complaint is filed against a Videographer's deficiency in service.


 

Complainant arranged his daughter's marriage ceremony on 27.04.2008. In connection to this marriage function, he arranged a videographer for taking CD cassette of marriage function. The booking had been done before one week of the marriage. At the time of of booking complainant paid Rs.1,000/- and the balance amount paid on the marriage day itself. After the marriage, complainant contacted the opposite party in many times, but he is not ready to give the C.D cassette. Complainant's repeated requests failed, so he filed this complaint.


 

2. Inspite of notice from this Forum, the opposite party was absent and not filed any written version. So the opposite party was exparte.


 

3. The point for consideration is whether there was any deficiency in service on the part of the opposite party, and if so, for what relief the complainant is entitled to ?


 

4. Complainant was examined as PW1 and Ext.P1 and MO1 marked on the side of the complainant. One witness on the part of the complainant was also examined as PW2.

5. POINT :- We have no chance to disbelieve the deposition of PW1 and PW2. MO-1 is the CD cassette produced from the bride groom and Ext.P1 is the copy of Marriage Certificate. It is very clear that the CD cassettes are played an important role in modern marriage function. Opposite party's act made mental agony and hardship to the complainant.

 

In this circumstance the petition is allowed. The opposite party is directed to produce concerned CD cassette or give back Rs.5,000/- to the complainant. The opposite party is also directed to pay Rs.1,500- as cost and Rs.2,500/- as compensation to the complainant within one month of receipt of a copy of this order, failing which the amount shall carry 12% interest per annum form the date of default.
