Ptn dt 28/01/2014 is taken up for hearing filed by O.p challenging the maintainability of the case.

We have gone through the ptn filed by .

On perusal of relevant materials on record and agreement we find that in agreement there is no signature of the complainant as well as there is no signature of witness.

It is construed that the agreement has not been accepted by the complainant and that being the position instant complaint case cannot be adjudicated without an agreement which is legally valid , since such agreement  cannot be termed as an agreement in the true sense of the term.

As such ptn filed by O.p dt 28/01/2014 is allowed and the case is dismissed and disposed of accordingly.
