Ms.Babita, Ld. Member has not come present today. Sh.Ashok Kumar, SPM, Model Town for OP1 had suffered a statement on 29.6.15 that the claim case in favour of the complainant Ms.Jyoti has been sanctioned by the Sanctioning Authority i.e. Senior Post Master, Ludhiana and the payment has since been made to the complainant on 9.6.15 for Rs.2,67,741/-, vide cheque no.403115 in the PPF Account no.27227. But today, he has stated at bar that this amount includes the interest, which became payable, but the department has not paid any amount on account of compensation and for deficiency in service or cost of litigation. Since they were not aware of the filing of the complaint by the complainant.
On the other hand, complainant Smt.Jyoti has stated that her husband died in the year 2012, since then, she has been making efforts to get the claim amount released from the OPs being nominee. However the OPs has made the payment of Rs.2,67,741/-, vide cheque no.403115 in her favour, after filing the of the present complaint on 27.5.15. Though the department has paid the amount of interest, but did not pay any amount on account of compensation for deficiency in service and also not paid the cost of litigation. For non-making of payment since the year 2012 till 9.6.15 complainant suffered a lot, which amounts to deficiency in service on the part of the OPs. Keeping in view of the above facts, it will be in the fitness of things, if the present complaint is disposed off with a direction to the OPs to pay the compensation and litigation costs to the complainant. As such, the present complaint is hereby disposed off with a direction to the OPs to pay Rs.8000/-(Eight thousand only) as compensation and Rs.2000/-(Two thousand only) as litigation cost to the complainant within 30 days from the receipt of the copy of the order, failing which OPs shall be liable to pay interest at the rate of 9% p.a. from today, till payment in addition to compensation and litigation cost. File be consigned to record room.
